The documents related to the land plot located at the intersection of Babayan and Ulnetsi streets of Yerevan city were examined in the Department of State Interests Protection of the Prosecutor General’s Office.
It was found out by the examination that A.P. won the lease tender of the land plot with the surface of 6900 m2 located at the intersection of Babayan and Ulnetsi streets. The latter informed with an application addressed to the Mayor of Yerevan, dated February 18, 2003, that he renounced the price suggested during the tender, as he was leaving the Republic of Armenia and asked to recognize someone else as the winner of the tender.
The other two participants of the tender also refused to sign a lease agreement, after which they suggested the fourth participant of the tender leasing the land plot and V.P was recognized the winner of the tender.
According to the lease agreement concluded between the Mayor of Yerevan and V.P. on October 14, 2003, the land plot with the surface of 6900 m2 located at the intersection of Babayan and Ulnetsi streets was transferred to V.P. for the term of 25 years. The preemptive right to purchase was also granted to the Lessee. As a result, by the decision of the Mayor of Yerevan the land plot with the surface of 6900 m2 was alienated to V.P. according to its cadastral value— AMD 10 million 105 thousand 878. By the decision of the Mayor of Yerevan dated July 18, 2011, Babayan 1/1 address was given to the abovementioned land plot.
By the agreement concluded on July 18, 2011, V.P. alienated the land plot to another citizen—I.P. and the latter alienated it to R.G. On February 27, 2020 R.G. included the whole land plot in the authorized capital of the limited liability company and on January 2023 the abovementioned company pledged its property, including the land plot to the bank for AMD 10 billion.
On August 23, 2023 the Department of State Interests Protection of the Prosecutor General’s Office examined the letter received from the Urban Development Committee and it was found out that the territory of the Victory Park was bound by Azatutyun Avenue, Saralanj and Babayan streets.
Besides that, by the decision of the Mayor of Yerevan, dated December 27, 2004, special regime of site development for the area enclosed by Ulnetsi and Babayan streets and railway was defined, that is limited opportunity for site development, which shall not be subject to alienation.
Taking into consideration the fact, that a case of alleged crime was found out during the examination, the prosecutor reported the crime to the Investigative Committee.
A criminal proceedings was initiated on September 20, 2023 under part 2 of article 446 of the Criminal Code.
