The damage caused to the state in the amount of AMD 650,000 was restored as a result of the application of prosecutorial act

Under a criminal proceeding pending in the Investigation Committee and supervised by the Department for Combating Economic Crimes of the Prosecutor General’s Office of the Republic of Armenia, it was revealed that A.T., being the Director of a company engaged in commercial and security printing, and having access to the actual data on the Company's gross income and taxable profit for the years 2014–2016, included distorted information in the reports submitted to the tax authority with the intent to evade payment of taxes in particularly large amounts.

 

In particular, A.T., in violation of the requirements of the Law “On profit tax” and Chapter 22 of the Tax Code (as in force at the time of the legal relationship), concluded false and formal service contracts worth AMD 2,560,765,000 during the years 2014–2016 with an organization that was in fact owned by M.M., the former Ambassador Extraordinary and Plenipotentiary of the Republic of Armenia to the Holy See. As a result of these actions, with the intent to evade payment of profit tax in particularly large amounts, he unjustifiably reduced the taxable profit and included distorted data in the annual tax calculations submitted to the tax authority for the years 2014, 2015, and 2016.

 

Taking into account that sufficient evidence existed within the criminal proceedings confirming the commission of the crime, on August 23, 2024, the prosecutor initiated a public criminal prosecution against A.T. under part 2 of Article 205 of the Criminal Code adopted on April 18, 2003 (failure to submit, in the manner and within the timeframes prescribed by law, a legally required report, calculation, declaration, or any other mandatory document that serves as a basis for calculating or paying a tax, duty, or other compulsory payment.)

 

Following the prosecutor’s decisions, charges were brought against A.T. As a result, the preliminary investigation recovered damages caused to the state in the amount of AMD 250 million, equivalent to USD 650,000.

 

On July 28, 2025, the supervising prosecutor terminated the public criminal prosecution initiated against A.T. due to lack of justifying grounds.
