During 2019-2020 the Prosecutor General’s office submitted state interest protection claims against Kotayk Marzpetaran and others, including against Z.G., wife of A.D. former mayor of Hrazdan on the requirements related to the recognition of the auction results and application of consequences related to specially protected 25 land plots with 48.5 ha total surface. The mentioned land plots are beyond the territory of Kotayk region and belong to the state.
On April 7, 2022 the First Instance Court of General Jurisdiction of Kotayk region granted the claim of the Prosecutor General’s office against Z.G. and Kotayk marzpetaran. As a result, the auction of “Lot 26” land plot, that was held on May 26, 2007 was recognized invalid, and Z.G. was obliged to return the land plot with 0.55 ha surface, located at Tsaghkadzor city of Kotayk region to the Republic of Armenia.
The decision was appealed in higher courts: as a result, the Court of Cassation (by the decision of August 3, 2023) reestablished the position of the Prosecutor’s Office and lower court, that during the disputed auction the law “On public bidding” was violated and left the judicial act on granting the claim of the Prosecutor’s Office unchanged.
Thus, by the final decision of the Court of Cassation the judicial act on returning the land plot with 0.55 ha surface, located at Tsaghkadzor city of Kotayk region to the Republic of Armenia entered into legal force.
During 2023, the Anti-corruption court granted another 3 claims of the Prosecutor’s Office on recognizing the abovementioned auctions invalid, and another 8,4 ha land plot shall be returned to the Republic of Armenia, in the event they enter into legal force.
The claims on recognizing the other auctions invalid are still in the proceedings of the Anti-corruption court.
