A damage of 10 million USD was caused to the State. Based on the report of the Prosecutor's Office, criminal proceedings were initiated

In the course of the examination, it was found that by the contract signed between the Republic of Armenia and "Armenia Studios" CJSC on September 14, 2005, the 24 thousand 292.6 sq. m. buildings and film production facilities located at 50 Chaush Street in Yerevan were alienated to the mentioned CJSC.

 

According to the contract, the obligations assumed by "Armenia Studios" CJSC were transferred to "CS Films" CJSC, founded on September 4, 2005, which was renamed to "Hamo Beknazaryan "Hayfilm" Cinema Studio" CJSC on October 10, 2008.

 

The contract envisages an investment of 30 billion AMD, of which at least 10 billion AMD is committed to be implemented by Hamo Beknazaryan "Hayfilm" Cinema Studio CJSC within 10 years. The deadline for the fulfillment of obligations was set on December 31, 2014, and the deadline for submitting the report was March 31, 2015. The contract also stipulates that the investor must have a guarantee letter from "Northern Trust" for 10 mln USD during the investment period.

 

During 2006-2009, "Hamo Beknazaryan "Hayfilm" Cinema Studio" CJSC invested 748 million AMD, and for the years 2010-2011, a report was submitted, which did not have proper justifications. The State Property Management Committee appealed to the investor in numerous letters to submit additional documents, which was not done.

 

Thus, for 10 years, in the conditions of fulfillment or non-fulfillment of a small part of the obligations assumed by Hamo Beknazaryan “Hayfilm” CJSC, the officials of the State Property Management Committee did not take any measures as a result of unscrupulous and negligent attitude towards the service on the part of CJSC in terms of filing a claim against the guarantor in the amount of 10 million US dollars in terms of non-fulfillment of the amount of a certain investment obligation, as a result of which the state suffered a loss in the amount of 10 million US dollars.

 

As a result, by the decision of the Government 1050-A of August 31, 2015, the contract signed on September 14, 2005 was terminated, the value of the property specified in the contract, 350 million AMD, was returned by the state to the customer, and 100 percent of the shares of "Hamo Beknazaryan" Hayfilm Cinema Studio" CJSC were registered as RA property.

 

The examination also revealed that in 2005-2016, stage items and technical equipment with an initial value of 2 million 658 thousand 220 AMD, which are historical and cultural assets, were stolen by "Hamo Beknazaryan "Hayfilm" Cinema Studio named after Hamo Beknazaryan" CJSC.

 

Taking into account that during the examination, cases of alleged crime committed by officials of the State Property Management Committee, as well as cases of theft of historical and cultural values, were found, on July 3, 2023, the prosecutor submitted a report on the crime to the Investigative Committee.

 

Criminal proceedings were initiated in the Investigative Committee under Article 446(2) /official negligence/, Clause 3 of Article 254(3), /theft of an object of special historical, artistic or cultural value/ and 447(1) of the Criminal Code (failure to take measures in accordance with the procedure established by the law to stop the arbitrary seizure of state or community-owned land plots, as well as the arbitrary construction of buildings or constructions).

 

Notice:  A person charged with any crime shall be presumed innocent until proved guilty in the manner prescribed by the RA Criminal Procedure Code—by the judgment came into legal force.
