For the purpose of executing the assignment of the Prosecutor General of the Republic of Armenia the Prosecutor’s Office of Arabkir and Kanaker-Zeytun administrative districts examined the alienation process of kindergartens transferred to the community by ownership right. Taking into consideration the fact that in case of alienation of the educational institution transferred to the community by the ownership right cannot be used for other purposes, the Prosecutor’s Office of Arabkir and Kanaker-Zeytun administrative districts submitted 5 claims to the Administrative court on June 5, 2023, on recognizing invalid the relevant  decisions of the heads of the community and members of the Council of Elders on alienation of kindergarten territories located at Arabkir and Kanaker-Zeytun administrative districts.

In the Administrative court the Prosecutor’s Office particularly disputed the following:  

1. Alienation of the building (former 147 nursery and kindergarten) with the surface of 141.5 m2 located at 5 D. Anhaght Str., Kanaker-Zeytun community of the city of Yerevan and as a result registration of the ownership right of the «N» LLC to the abovementioned territory.

2. Alienation of the building (former 199 nursery and kindergarten) with the surface of 126.9 m2 located at 1st floor of 21a Dro Str., Kanaker-Zeytun community of the city of Yerevan and as a result registration of the ownership right of A. J. to the abovementioned territory.

3. Alienation of the building (former 132 kindergarten) with the surface of 121.2 m2 located at 1 Hr. Nersisyan Str., Kanaker-Zeytun community of the city of Yerevan and as a result registration of the ownership right of A.G., N.S., A.H. to the abovementioned territory.

4. Alienation of the building (former 132 kindergarten) with the surface of 83.9 m2 located at 1 Hr. Nersisyan Str., Kanaker-Zeytun community of the city of Yerevan and as a result registration of the ownership right of E.V. to the abovementioned territory.

5. Alienation of the building (former 159 kindergarten) with the surface of 2575,5 m2 located at 32 Z. Kanakertsi  Str., Kanaker-Zeytun community of the city of Yerevan and as a result registration of the ownership right of S.S., A.E.  to the abovementioned territory.

Prosecutor’s offices of the Administrative districts submitted claims based on the materials of two criminal proceedings.   

In the Administrative court the Prosecutor’s Office particularly disputed the following:  

• The decision on recognizing the state registration of the ownership right of Yerevan Technological Equipment Plant Closed Joint-Stock Company to the land plot with the surface of 23153,65 m2 located at 8 Davit Anhaght Str., city of Yerevan invalid.
• The decision of alienation of the land plot with the surface of 2370 m2 located at 50 Z. Kanakertsi Str. city of Yerevan to Khacharam Konservatoria LLC.
