Today the RA National Assembly discussed the appeal by Anna Vardapetyan, the RA Prosecutor General on initiating public criminal prosecution against Armen Charchyan, the Deputy of the NA.

On March 17, 2017 the criminal case N 69100817 was initiated under Article 130, Part 2 of the RA Criminal Code adopted in 2003.

During the preliminary investigation evidence was obtained on delivering false conclusion by the experts and the criminal case N 61200319 was initiated under Article 338, Part 2, Point 1 of the Criminal Code, adopted in 2003, which was joined with the criminal case N 69100817.

The Prosecutor supervising over the criminal case suggested the Prosecutor General apply to the RA National Assembly to initiate criminal public prosecution against the Deputy Armen Charchyan.

In the course of the preliminary investigation, it was proved that Armen Charchyan, being the Executive Director of the “Izmirlian” Medical Center and being a member and an expert in the Commission of medical and judicial expertise within the case of Artur Sargsyan, provided a false conclusion on 8 February 2017.          

Detention was chosen as a preventive means against the accused Artur Sargsyan and he was taken to “Nubarashen” criminal-executive institution. According to the medical card filled in by the Head of the Medical service of the criminal-executive institution, the diagnosis of Artur Sargsyan, included also “Bekhterev’s disease” which was listed as a serious disease according to N 825-N Decision of the RA Government of May 26, 2006 and in case of this disease Artur Sargsyan wouldn’t be able to serve his punishment in the criminal-executive institution and would need treatment in a professional unit.

Armen Charchyan witnessed that according to the studies of Artur Sargsyan’s medical documents it was possible to conclude that “Bekhterev’s disease” had not serious progress and was not classified under Decision 825-N of 2006 of the Government.

Experts Artur Ghambaryan, Yervand Sahakyan, Alla Sanaghyan, Astghik Karapetyan, Nelly Khostikyan, Qnarik Ginosyan, Ararat Levonyan and Tatevik Sahakyan were also interrogated during preliminary investigation.

It was found out that only once the members of the commission were present at the meeting to discuss the expert’s conclusion on Artur Sargsyan, but at that time, on February 8, 2017, from 12:17 to 14:00 Armen Charchyan was at “Izmirlian” Medical Center.  

Though the accused had Bekhterev's disease with a severe progressive musculoskeletal system, dysfunctions of many organs and it was classified under 37 paragraph of the appendix 2 of the Decision 825-N of 2006 of the Government.
