On May 19, 2023 the supervising prosecutor approved the indictment on the illegal fishing in “Sevan” Branch of the Sevan National Park SNCO and receiving bribe and submitted it to the Anti-Corruption Court with the materials of the proceedings.
We would like to remind you that on July 12, 2019, a criminal case was initiated in the General Investigative Department of the National Security Service under part 1 of article 308 and point 2 of part 2 of article 292 of the Criminal Code. The preliminary examination was assigned to the Regional Investigative Department of Gegharkunik.
On September 22, 2022, on the basis of the motion of the investigator of the Regional Investigative Department of Gegharkunik of the Investigative Committee, the Prosecutor’s Office of Gegharkunik region rendered a decision on terminating the criminal proceedings against S.T., Director of “Sevan” Branch of the Sevan National Park SNCO, inspectors A.G. and H.H. as well as citizens D.P., D.M. and A.U. based on the fact of not performing the incriminated actions and decriminalization of actions.
On September 30, 2022, the criminal proceedings was terminated by the decision of the investigator.
On January 7, 2023, by the decision of Artur Poghosyan, Deputy Prosecutor General of the RA, overturned the following decisions—Decision on termination of the criminal proceedings against the accused S.T., D.M., A.U., D.P., A.G., H.H. adopted by the senior prosecutor of Gegharkunik region on September 22, 2022 and Decision on termination of the criminal proceedings rendered by the Deputy Head of Martuni Investigative Division of the Regional Investigative Department of Gegharkunik on September 30, 2022 and approved by the supervising prosecutor on October 8, 2022.
Through the preliminary examination carried out on the basis of the assignment of the Deputy Prosecutor General, it was found out that S.T. holding the position of the director of “Sevan” Branch of the Sevan National Park SNCO since 2017 and being obliged to prevent the illegal fishing from the “Sevan” Branch, permitted the citizens involved in this case (proceedings) related to giving bribe to carry out illegal fishing from the “Sevan” Branch, which was under his supervision. As a result 49 kg fish was illegally caught from the beach named “Bardiner”, thus causing damage in the amount of AMD 245 000.
A new public criminal prosecution was initiated against S.T. under part 2 of article 311 (4 counts) of the Criminal Code and against H.H., A.G., D.P. and D.M. under part 1 of article 312 of the Criminal Code.
