03.10.2022 | Indictment was made against Vrezh Markosyan in the case of complicity in a crime with Aghvan Hovsepyan

On April 15, 2022, the Prosecutor General's Office sent a criminal case against Aghvan /Garnik/ Hovsepyan and Vrezh /Varantsov/ Markosyan to the First Instance Court of General Jurisdiction of Yerevan City which was accepted to proceedings according to the decision of the court of April 19, 2022.

 

Let's remind that in the mentioned case, V. Markosyan was accused for committing publicly dangerous act that is, at the instigation of A. Hovsepyan, who held the positions of the RA Prosecutor General and then the Chairman of the RA Investigative Committee, on April 10, 2017, squandered the land plot with the area 3.0078 hectares, with the value of 672.400.000 AMD entrusted to him by Varsham Gharibyan, located at No. 29/11 G1 blocks  of Ajapnyak community, Yerevan, by donating it to A. Hovsepyan's son, Armen Hovsepyan, whose ownership right to that plot of land was registered in the RA State Committee of Real Estate Cadastre on April 13 of the same year.

 

According to the decision of the court on August 4, 2022, the criminal case against the accused V. Markosyan was split from the mentioned criminal case.

 

During the court hearing of September 16, 2022, the accused V. Markosyan declared that he pleads guilty on all accounts and requested to apply the conciliation procedure. The court granted the motion of the accused.

 

Bearing in mind that V. Markosyan is 72 years old, as well as based on the provisions of the relevant norms of the Criminal and Criminal Procedure Codes, within the framework of the conciliation proceedings, the parties agreed on the following type of punishment and punishment for the act for which the defendant is guilty:

 

  • Imprisonment for 5 years and 4 months was imposed on V. Markosyan (in this case, it is the maximum sentence that could be imposed within the framework of the conciliation proceedings).
  • Apply on 01.11.2018 Article 2, Part 2, Point 5 of the RA Law "On declaring amnesty in criminal cases in connection with the 2800th anniversary of the founding of Erebuni-Yerevan and the 100th anniversary of the declaration of independence of the first Republic of Armenia" and release V. Markosyan from the determined punishment.

 

In the result V. Markosyan was found guilty of committing the relevant crime according to the judgment of the First Instance Court of General Jurisdiction of Yerevan City of October 3, 2022 and was sentenced to 5 years and 4 months imprisonment, and, according to Article 2, Part 2, Point 5 of the RA Law "On declaring amnesty in criminal cases in connection with the 2800th anniversary of the founding of Erebuni-Yerevan and the 100th anniversary of the declaration of independence of the first Republic of Armenia" was released from the determined punishment.

 

It should also be noted that in the scope of the reconciliation proceedings, the victim did not file a claim against V. Markosyan.
