27.06.2022 | First guilty verdict for willful failure to file a declaration of property and income

On February 25, 2022 documents were received to the RA Prosecutor General's Office from the Corruption Prevention Commission on the deliberate failure to submit annual declarations on property, income and interest for the same year to the said commission by A.M., the former deputy head of the Mrgavan community of Ararat region, in accordance with the Law of the Republic of Armenia “On State service" in accordance with part 1 of Article 169.28 of the Code "On Administrative Offenses". They were sent to the Anti-Corruption Committee as a pretext for initiating a criminal case in accordance with the established procedure with instructions to prepare materials and settle the case.


Based on the materials prepared by the Anti-Corruption Committee of the Republic of Armenia, on March 9, 2022, a criminal case was initiated on the grounds of Part 1 of Art. 314.2 of the RA Criminal Code.


With a sufficient combination of evidence obtained during the preliminary investigation, on March 22, 2022, A.M. was brought in as an accused and he was charged under part 1 of Article 314.2 of the RA Criminal Code. He fully pleaded guilty and confessed. As a measure of restraint in relation to A. M., a written undertaking not to leave the place was chosen.


On March 24, 2022 the prosecutor supervising the legality of the preliminary investigation of the criminal case approved the indictment, and the criminal case was sent to the court of general jurisdiction of first instance of Ararat and Vayots Dzor regions.


According to the court verdict of June 21, 2022, A. M. was found guilty under Part 1 of Art. 314.2 of the Criminal Code of the Republic of Armenia and sentenced to 1 /one/ year of imprisonment with deprivation of the right to hold leadership positions in state bodies and local self-government bodies for a period of one year.


Punishment in the form of deprivation of liberty was not applied to A. M., a probationary period of 2 years was established.


The above is the first criminal case initiated and considered under Article 314.2 of the Criminal Code of the Republic of Armenia since the criminalization of this act (09/06/2017), in which the court of first instance delivered a guilty verdict.
