03.06.2022 | The Prosecutor's Office submitted a claim to the court to confiscate 5.6 billion AMD in a criminal case, which was accepted into the proceedings

The investigation of the criminal case proved that from May 16, 2002 G. Hakobjanyan with the suggestion of S. Mayrapetyan's, hold the position of director of "Globus" LLC, actually owned by the latter. In 2004 "Globus" LLC signed an agreement with another LLC, and on that ground providing construction works the latter built a residential building with a total area of ​​28650.63 square meters in the Teryan Street 66, Yerevan, in 2006.

 

Immediately after construction, S. Mayrapetyan aimed not to pay particularly large taxes and organized the process of purchase and sale procedure with false, significantly lower price than the market values ​​of 141 units of real estate belonging to "Globus" LLC. In the result, contracts were signed between G. Hakobjanyan and individuals, in which the price of 1 square meter was stated at around 66,000 AMD, the value of parking spaces at around 75,000 AMD, and the value of non-residential areas at around 61,000 AMD. Meanwhile, in the same period, the market value of 1 square meter of an apartment in the given area was 770,000 AMD, the price of a parking space was 160,000 AMD, and the price of a non-residential area was 875,000 AMD.

 

In the result of this process, G. Hakobjanyan has not included the actual income of the "Globus" LLC company to the tax authority, so a large amount of money, 5.678.764.260 AMD tax state was not paid to the state budget.

 

G. Hakobjanyan's application was received on 7 December, 2021 in which the latter did not object and requested to terminate the criminal prosecution initiated against him under Article 205, Part 2 of the RA Criminal Code on the basis of the expiration of the statute of limitations.

 

Decision on terminating the criminal prosecution against Hakobjanyan was made at the RA Anti-Corruption Committee on 27.12.2021.

 

Taking into account that there is a violation of the property interest of the state, the Department of State Interests Protection of the RA General Prosecutor's Office filed a lawsuit to the Court of General Jurisdiction of the city of Yerevan to confiscate 5.678.764.260 AMD from S. Mayrapetyan and G. Hakobjanyan in favor of the state budget, With the demand Hakobjanyan.

 

According to the court's decision, the claim was admitted into the proceedings and the property belonging to the defendants in the amount of the claim was seized.
