05.05.2022 | Senior RP inspector sentenced to prison for issuing driver's licenses in exchange for a bribe

Preliminary investigation of the case initiated by the Investigation Department of the National Security Service of the Republic of Armenia on March 31, 2020, assigned to the RA SIS for conducting the proceedings,  established that the Chief Inspector of the Sevan Registration and Examination Department of the RA Road Police Service committed a deliberately illegal act in favor of 3 persons.

 

In particular, it turned out that in violation of the law, without checking the theoretical knowledge and practical skills of persons who applied for a driver’s license, in March 2020 he took formal theoretical and practical exams, issued driver’s licenses to 2 persons. In exchange for committing this obviously illegal act in favor of the latter, he received a bribe in the amount of 102.000 and 200.000 drams with the help of the Head of Sevan Passport Department of the RA Police Passport and Visa Department of the Gegharkunik Region.

 

It is also substantiated that in March 2020 a citizen turned to his relative, the foreman of Gavar driving school of "DOSAAF of Armenia" NGO, to assist him in obtaining a driver's license in exchange for a bribe, who for this purpose took 250.000 drams from him. After that, the latter met with the above-mentioned senior inspector of the Registration and Examination Department service of the RA Road Police, agreed with him to issue a driver's license in exchange for a bribe in the amount of 200.000 drams, and gave this amount to him.

 

In order to hide the fact of receiving a bribe, in accordance with the established procedure, the senior inspector wrote a false protocol stating that he took a theoretical exam from a citizen and, given that he gave 9 correct answers, positively assessed his exam.

 

The senior inspector of the registration and examination department of the Sevan Road Police was charged under Part 1 of Article  308 /2 episodes/, paragraph 3 part 3 of Article 311, part 2 of Article 311 and under part 1 of Article 314 of the RA Criminal Code, the head of the Sevan Passport Department of the RA Police Passport and Visa Department was also charged under part 1 of article 313 of the RA Criminal Code.

 

The master of Gavar driving school was charged under Part 1 of Article 313 of the Criminal Code of the Republic of Armenia, another personwas charged under Part 2 of Article 312 and part 1 of Article 38-314 of the Criminal Code of the Republic of Armenia.

 

The criminal case against these 4 persons was sent to the first instance court of general jurisdiction of Gegharkunik region.

 

As a result of the trial on April 19, 2022, the First Instance Court of General Jurisdiction of the Gegharkunik region issued a guilty verdict, by which the named 4 persons were found guilty of the criminal acts they were accused of. In particular, in the case of the senior inspector of the Registration and Examination Department of the RP, on the principle of partial addition of punishments, the final punishment of 5 years of imprisonment was assigned with deprivation of the right to hold certain positions for 2 years.

 

Regarding the remaining three defendants, the final punishment in the form of a fine was again imposed on the principle of partial addition of punishments.

 

After the judicial act enters into force, measures will be taken to invalidate the driver's license issued on the basis of the results of the theoretical exam.
