Within the framework of the criminal case initiated on the basis of the publication dated 28.09.2018 on electronic newspaper “Hetq” entitled “Officials privatized 60 h. of forest in Tsakhkadzor” The RA Prosecutor General’s Office, having established the fact of violation of state interests, in the period of 2019-2020 filed a lawsuit for the protection of public interests, by which were challenged the auctions held in 2007 for 25 land plots outside the administrative boundaries of Kotayk region.
By the verdict of the Court of General Jurisdiction of First Instance of Kotayk region of the Republic of Armenia, the claim submitted by the Prosecutor General's Office of the Republic of Armenia against the Kotayk marzpetaran was satisfied.
The court also obliged the citizen to return the specified land plot to the Republic of Armenia, and obliged marzpetaran of Kotayk region to return the price of the invalid land purchase and sale agreement in the amount of 3.435.500 AMD.
This decision of the court is important for the trial initiated by the Prosecutor's Office to invalidate the auctions of land plots in Tsakhkadzor and restore the violated property rights of the state.
Issues on the recognition of the auction for 24 land plots as invalid and the application of consequences, submitted by the RA Prosecutor's Office, are still in court, and in the future the public will be informed about the results of the investigation.
The lawsuit of the Prosecutor General's Office of the Republic of Armenia against Kotayk marzpetaran was satisfied by the judgment rendered by the Court of First Instance of General Jurisdiction of Kotayk region of the Republic of Armenia. In particular, by the court verdict of 26.05.2007 the auction of the said land plot was invalidated and, as a consequence, the contract for the sale of the land plot was also invalidated.
The court also obliged the citizen to return the specified land plot to the Republic of Armenia, and obliged the marzpetaran of Kotayk region to return the price of the invalid land purchase and sale agreement in the amount of 3.435.500 drams.
This decision of the court is important for the trial initiated by the Prosecutor's Office to invalidate the auctions of other land plots in Tsakhkadzor and restore the violated property rights of the state.
The issues submitted by the RA Prosecutor's Office on the recognition of the auction for 24 land plots as invalid and the application of consequences are still under consideration by the court, and in the future the public will be informed about the results of the investigation.
