09.03.2022 | An employee of the PI got closer with the prisoner, tried to transfer alcoholic drinks for him to the penitentiary for a bribe. The petition was submitted to the service of PI of the MoJ

A preliminary investigation has been completed on a criminal case on the transfer of alcohol to a prisoner for a bribe by an employee of the Nubarashen Penitentiary Institution of the Ministry of Justice of the Republic of Armenia.


In fact, регардинг this case on November 28, 2021. the body conducting the proceedings on the criminal case initiated by the Anti-Corruption Committee of the Republic of Armenia substantiated that the specialist of the security department of the penitentiary institution Nubarashen, having official powers to ensure the order of internal service and security in the penitentiary institution, met with a close friend of the prisoner in Yerevan and accepted the offer of a bribe from the latter in in the amount of 100,000 drams for the transfer of alcoholic beverages prohibited to him to the above-mentioned penitentiary.


On November 21, 2021 they met again, the penitentiary officer received alcohol-methylalcohol-containing liquids packaged in 5 plastic containers (0.5 liters), as well as the indicated amount of the bribe.


On the day of the shift, the employee took the prohibited items to the penitentiary institution. However, as a result of the vigilance of the employees of the institution, by their demand, he showed the containers in the package, which were seized in the prescribed manner. That is, for reasons beyond his control, he could not pass the drinks to the detainee.


For the commission of these criminal acts, the latter was charged under Part 2 of Art. 311 of the Criminal Code of the Republic of Armenia for illegal action by an official, and the prisoner was charged under Part 1 of Art. 312 of the Criminal Code of the Republic of Armenia for giving a bribe.


The prosecutor approved the indictment and sent the criminal case against 2 persons to the court of general jurisdiction of the city of Yerevan for consideration on the merits.


Taking into account the indicated circumstances, as well as the fact that such manifestations of such a dishonest attitude towards service can create an atmosphere of impunity among convicts and detainees, and thus become a reason for committing new crimes, a petition was sent from the RA Prosecutor General’s Office to the head of the criminal executive service of the MJ.
