17.01.2022 | By 29 cases in connection with the early elections to the National Assembly of the Republic of Armenia in 2021. 53 persons were brought to court within the framework of the case, 6 persons were convicted

The Prosecutor General’s Office of the Republic of Armenia summed up the results of the work on the investigation of cases of possible electoral crimes found during the entire period of the early elections to the National Assembly of the Republic of Armenia on June 20, 2021, including the election campaign, as well as possible criminal acts that are not of electoral nature, but related to them, with a view to bring the perpetrators of the crime to criminal liability.

 

Accordingly, on the fact of reports sent to the bodies of preliminary investigation and inquiry on initiated 87 criminal cases, charges were brought against 91 persons. Moreover, 67 of the latter or 73.5% were charged with electoral bribery.

 

As of January 1, 2022, the proceedings of 14 criminal cases were suspended, by 24 criminal cases decisions were made to terminate the criminal case, with a view to refuse to initiate a criminal case, and in some cases to terminate the criminal prosecution.

 

Another 20 criminal cases are being investigated, by which 34 people are accused. Including,

 

  • 24 - for giving, receiving or mediating, attempting to give bribe;
  • 6 - for violating the secrecy of voting;
  • 1- for voting or attempting to vote more than once or instead of another person;
  • 1- for preparing to obstruct the exercise of the right to vote using official position;

 

Eight of the defendants in all cases were candidates from a party or party bloc participating in the early parliamentary elections.

 

As a measure of restraint against 24 accused detention was applied. During the investigation, the detention was changed or canceled in relation to 12 persons by the prosecutor or by a court order using other measures not related to deprivation of liberty.

 

 In the post-election period, 29 criminal cases related to pre-election crimes were sent to court with indictments. A total of 53 people were brought to criminal responsibility, including:

 

  • 42 - for giving, receiving or mediating, attempting to give bribe;
  • 4- for committing criminal acts for damaging campaign posters, causing material damage;
  • 2 - for forcing one or more persons to participate in the election campaign of a party or block of parties using their official position;
  • 1- for trying to vote more than once or on behalf of another person;
  • 1- for preparing to obstruct the exercise of the electoral right by a group of persons using their official position;
  • 1- for the use of violence in the district center or near it;

 

By 5 cases sent to court, a guilty verdict was rendered. 4 persons were sentenced to imprisonment, in respect of 3 of which the court did not apply a probationary period. And within the framework of 2 cases, 2 persons were sentenced to a fine.

 

 The judicial investigation of 22 cases against 42 persons sent to court is still in process.
