26.10.2021 | Criminal case concerning the bribe from business entities by officials of the State Revenue Committee was sent to court

During the preliminary investigation of the criminal case, carried out in the Investigative Department of the National Security Service of the Republic of Armenia initiated on 10.06.2021 under Part 1 and Part 2 of Art. 312, Point 2 of Part 4 of Art. 311, Part 1 of Art. 308 of the RA Criminal Code, sufficient data were obtained that the Head of the Division serving the territory of Lori region of the Operative-Search Department of the RA SRC and some employees committed corruption abuses.


In particular, by prior agreement with 5 persons who are the actual head of economic entities for not fixing various violations in the field of tax legislation and not being prosecuted in May-June 2021 demanded from them a bribe in the amount of about 1.800.000 AMD, from this amount they actually received 1.600.000 AMD and divided it between them, and the rest of the amount of 300.000 AMD they agreed to receive partially in the coming months.


4 officials and 5 employees of these economic entities were charged for the commission of the above criminal acts. In particular, the Head of the Department serving the territory of Lori region of the Operational-Search Department of the State Revenue Committee of the Republic of Armenia was charged under Points 2 and 3 of Part 3 of Art. 311 of the RA Criminal Code, one of the operatives authorized under Part 2 of Art. 311 of the RA Criminal Code and 2 episodes under Point 2 and Point 3 of Part 3 of Art. 311 of the RA Criminal Code, 2 other operatives were charged under Points 2 and 3 of Part 3 of Art. 311 of the RA Criminal Code.


Against 4 accused, who were employees of the SRC, detention was chosen as a measure of restraint (later, bail was applied against one by a court decision), against others, measures of restraints not related to imprisonment were finally applied.


In the course of the preliminary investigation against 2 people, with the consent of the prosecutor, the criminal prosecution was terminated, taking into account that they had given confessional testimonies and contributed to the disclosure of the crime.


On October 25, 2021 the criminal case against the remaining 7 accused with an approved indictment from the RA Prosecutor General's Office was sent to the Court of General Jurisdiction of the First Instance of Lori region with a view to consider the case on the merits.


Preliminary investigation of the cases of non-registration of various violations committed by some other business entities continues, measures are being taken to provide final legal assessments of the actions of the persons involved.


Notice: Every person suspected in or charged with a criminal offense shall be presumed innocent unless proved guilty in the manner prescribed by the RA Criminal Procedure Code and unless the verdict comes into legal force.
