22.10.2021 | 22 criminal cases passed to the court on 46 people, 76 per cent out of them was electoral bribe: summary

The RA Prosecutor General's Office has summarized the outcomes of electoral violations during the whole period of the Early Elections of the RA National Assembly held on June 20, 2021, including before the launching of official campaign, the election day and the following period regarding investigation of crimes conditioned by elections, prosecuting as of 15 October 2021.

 

 

In addition, 80 criminal cases were initiated on the reports sent to the investigative bodies, 91 persons were charged. Out of them:

 

 

•   67 persons for giving and receiving bribe, electoral bribery mediation, attempt, assistance and organization of giving bribe,

3 – hindrance to participate in the election campaign by using violence,

6 - breaching the confidentiality of ballot,
6 – damage and destruction of property related to posters of election campaign,
3 - forcing participation of one or more people in electoral campaign by using official authority,
2 – force to take part in elections, elect or not to elect the party or alliance (for promising also to provide free services in the name of charity),   
2 - voting more than once or instead of another person,
1 – for not reporting a criminal offence,
1 – for fraud.

 

 

Thus, the number of people engaged as an accused for electoral bribe is about 73.5%.   

 

 

8 out of the accused persons are Deputy Candidates, in particular, 2 from the Alliance “Armenia”, 4 people from the Alliance “I have honor”, 1 from the Party “Prosperous Armenia”, 1 from the Party “Rise”.

 

 

Imprisonment was chosen as preventive means against 24 of them, including all the Deputy Candidates. In the course of investigation detention as a preventive means was chosen with another means of prevention or was canceled against 5 people.

 

 

As of 15 October 2021, 22 criminal cases on electoral offences were sent to the court for further examination. 46 persons were brought against the court.  

 

 

  • 35 persons for giving bribe, electoral bribery mediation, attempt, assistance and organization of giving bribe, preparation to receive bribe,
  • 3 – attempt for voting more than once or instead of another person,
  • 2 - force to take part in elections, elect or not to elect the party or alliance,
  • 2 - forcing participation of one or more people in electoral campaign by using official authority,
  • 4 – damage and destruction of property related to posters of election campaign.

 

The total number of the people sued for corruption crime is 76 per cent.

 

An indictment was filed on 1 case sent to the court, punishment for 4 years was introduced against 1 person, at the same time the punishment was not implied against the defendant putting on probation for 5 years terms. Regarding the other cases the judicial examination is underway.

 

9 people sued were Deputy Candidates from the Alliance “Armenia”, 22 people from the Alliance “I have honor”, 1 from the Party “Prosperous Armenia”, 1 from the Party “Rise”.

 

The preliminary investigation on 39 criminal cases investigated on the Early Elections of the RA National Assembly held on 20 June 2021 is underway, some cases were terminated, and others were joined.

 

Although the preliminary investigation and court investigation on the most part of the cases is underway, it may be stated that the Early Elections of the RA National Assembly held on June 2021 is significantly different from the elections held in 2017 and in 2018 as for the efficiency of the activities by the law enforcement bodies against electoral crime.

 

As for comparison, the criminal cases initiated on electoral crimes are almost 4 times more in 2021 than in 2017 and 7 times more than in 2018. The criminal cases sent to the court with indictments are twice much than in 2017 and the number of people sued for them in 70 per cent.

 

It is worth of mentioning that cases of giving and taking electoral bribe, mediation of bribery, detection of other related offences, criminal prosecution and bringing to the court have not such results compared with former national elections.

 

Such outcomes may be preventive for the further elections and may provide favorable conditions for the free and unbending will of the electors in the RA as well as for providing democratic, transparent elections.
