03.08.2021 | For the operation of the SHЕP, the company submitted a water use permit with deliberately false content. Criminal case was initiated

The Department for Protection of State Interests of the RA Prosecutor General's Office studied the documents received from the RA Ministry of Environment regarding the water use permit of the CJSC operating the SHEP, as a result of which factual data containing signs of a criminal act were obtained.

 

In particular, it was found out that the CJSC operating SHEP in Gegharkunik region on October 28, 2020 submitted to the Ministry of the Environment an application for the extension of the validity period of water use permits No. 000367 and No. 000366, issued on 16.11.2015.As a result of the assessment of the latter, it was found out that there are inconsistencies between the water use permits submitted by the company and the water use permits registered in the Division of state cadastres, maintenance of registers and monitoring of Department for licenses, permits and compliances of the RA Ministry of Environment. 

 

In particular, in the water use permit registered in the Division of state cadastres, maintenance of registers and monitoring of the Department for licenses, permits and compliances of the RA Ministry of Environment the resource is indicated under the name of the Dzoragyugh river, and in the water use permit submitted by the company, a metal pool near the SHEP Dzoragyugh-3 is indicated. In addition, in the water use permit No. 000367, submitted by the company, the place of drainage is a metal basin, however, in the water use permit registered in the Division of state cadastres, maintenance of registers and monitoring, the place of drainage is indicated under the name of the Dzoragyugh river.

 

Thus, with a view to extend the validity period of the CJSC water use permits No. 000366 and No. 000367 on October 28, 2020 water use permits with false records were submitted to the RA Ministry of Environment.

 

Taking into account that in the course of the study, sufficient data were obtained on the presence of signs of falsification of a document granting the right, implementation and use of the document in the Department for the Protection of State Interests of the RA Prosecutor General's Office, a criminal case was initiated under Part 1 of Art. 325 of the RA Criminal Code, and the preliminary investigation of the case was transferred to the RA Investigative Committee.
