27.07.2021 | 10 criminal cases in Lori region, 2 verdicts for cases of domestic violence during the first half of 2021

The Prosecutor's Office of Lori region of the Republic of Armenia studied the results of the criminal-legal fight against domestic violence during the first half of 2021 on the territory of the region. Therefore, during the 1st half of 2021, 10 cases of domestic violence were registered. For the same period last year, 1 such case was registered.

 

Such a difference is conditioned by the activity shown in the issue of appeal to law enforcement agencies by citizens who have suffered as a result of domestic violence in the region, as well as the consistency shown by the Prosecutor's Office of the region in giving criminal-legal assessments to such cases.

 

By the supplement of Part 4 of Art. 183 of the RA Criminal Procedure Code from January 01, 2018 the prosecutor was given the exclusive right in cases of private accusation to initiate criminal proceedings without the person's complaint regarding all those cases of domestic violence, when, in the opinion of the prosecutor, due to the fact that the person is in a helpless state or is dependent on the alleged rapist, he/she cannot protect his/her legitimate interests.

 

 On the basis of this legal regulation in the Prosecutor's Office of Lori region of the Republic of Armenia during 2021, 10 criminal cases were initiated under Art. 117 or Art. 118 of the RA Criminal Code, in 1 case - under Art. 118 and Part 1 of Art. 137 of the RA Criminal Code.

 

For example, in one case, a resident of the city of Alaverdi gave a report in Tumanyan Division of the RA police that on the same day, at around 15:00, during a quarrel, her husband kicked and punched her and caused bodily injuries.

 

During the preparation of the materials, the woman gave a message, adding that her husband had also used violence against her earlier, but she made up with him and did not submit any complaints or demands.

 

The husband, by his explanation, did not deny that during a quarrel in their apartment he beat his wife. According to the forensic medical conclusion, the wife's bodily injuries did not show signs of minor harm to health.

 

During the preparation of the materials, it was found out that the husband was pleaded guilty for beating his wife on 01.06.2020 by the verdict of the Court of General Jurisdiction of the First Instance of Lori region under Art. 118 of the RA Criminal Code and sentenced to a fine in the amount of 40000 AMD.

 

However, the next day on 02.06.2020 the latter again beat his wife, and on this occasion, based on the prepared materials, a decision was made to refuse to initiate a criminal case on the basis of the absence of a complaint.

 

As a result of studying the factual data available in the materials, the prosecutor supervising the materials, being guided by Part 4 of Art. 183 of the RA Criminal Procedure Code, made a decision to initiate a criminal case under Art. 118 of the RA Criminal Code.

 

Or in another case, a resident of Vanadzor gave a message in Bazum Division of the RA police that on the same day at around 11:00, during a quarrel in his apartment, his son stabbed him in the face and head.

 

During the explanation, the son did not deny that he had quarreled with his father and during the quarrel he stabbed him several times in the head with a knife.

 

According to the forensic medical conclusion, some of the injuries were caused by a sharp cutting tool (knife), and the rest as a result of a blunt object.

 

Based on the prepared materials, it was found out that before this incident he had again quarreled with his father and during the quarrel hit him on the head with an iron stick, and regarding this case, based on the materials prepared in Bazum Division, a decision was made to refuse to initiate a criminal case on the basis of the absence of a complaint.

 

That is, in this case there was the presence of domestic violence and, based on this, the prosecutor supervising the materials under Art. 117 of the RA Criminal Code initiated a criminal case.

 

In total, by the mentioned 10 criminal cases against 10 persons for committing domestic violence was initiated a criminal prosecution. And 2 criminal cases against 2 persons were sent to the court with an indictment for consideration on the merits, by which convictions have already been rendered.

 

Taking into account the fact that cases of violence in families were repeated, and the Police under Art. 15 of the RA Law "On the Prevention of Domestic Violence and Protection of the Rights of Victims of Domestic Violence and Restoring Peace in the Family" has a specific responsibilities for taking measures aimed at the protection of people who were subjected to violence the Prosecutor of Lori region turned with a petition to the First Deputy of the Chief of the RA Police A. Hovhannisyan.

 

The prosecutor of the region emphasized the need to intensify the work of the employees of the Department of Lori region of the RA police on the prevention and application of measures of influence provided for by law in relation to the control of the behavior of persons using violence against family members.
