20.06.2021 | 338 reports on electoral crimes received the day before the election - June 19, 26 criminal cases were initiated, 21 people were prosecuted: summary

The RA Prosecutor General's Office has summarized the outcomes of electoral violations during the whole period of the Early Elections of the RA National Assembly before the launching day of official campaign, including the mediate outcomes regarding alerts, reports and actions undertaken on them.



During the reporting period, in general, 338 reports and alerts were received. Out of them:



  • 123 – media publications,
  • 91 – reports received by natural entities, including received through the hotline of the RA Prosecutor General's Office,
  • 2 – received by the Office of Human Rights,
  • 65 – posts made by the citizens on the social networks,
  • 57 – operative data received from the police officers.


From the reports and alerts on criminal offences:



  • 155 - are related on giving, receiving and mediation of electoral bribe (Article 154.2 of the RA Criminal Code and Article 154.9 of the RA Criminal Code),
  • 59 - hindrance to implementation of the right to elect (Article 149 of the RA Criminal Code),
  • 64 – forcing and hindering participation in electoral campaign (Article 149.1 of the RA Criminal Code)
  • 42 - damage of property related to posters of election campaign and of such nature (Article 185 of the RA Criminal Code)
  • 18 – others (Article 177, 137, 118, 164 and 308 of the RA criminal Code).


Regarding 22 reports on electoral crime allegations which were abstract and had general nature, were sent to the RA Police to undertake necessary verification measures. In the result of operative-investigative measures undertaken in regard with reports and alerts the mentioned information was not affirmed regarding 77 cases mentioned and they remained without consequence, on 135 reports verification measures are underway.



From the mentioned 338 messages 126 reports were sent for investigation or preliminary investigation with the instruction to prepare materials in the manner prescribed by Articles 180-181 of the RA Criminal Procedure Code. As a result, on 35 cases, the initiation of criminal prosecution was refused, 65 cases are in the phase of preparation of materials.



Criminal cases have been initiated on 26 cases, out of which:



•   17 cases were according to different parts and combination of Articles 154.2, 154.9, 34-154.2 of the RA Criminal Code,


  • 3 – according to Article 149.1 of the RA Criminal Code,
  • 1 – according to Article 149, Part 2, Points 1 and 2 of the RA Criminal Code,
  • 5 – regarding destroying of posters according to different parts of Article 185 of the RA Criminal Code.  



Regarding the mentioned cases criminal prosecution was initiated against 14 people, out of them 6 - for giving bribe and attempt of giving bribe, 1 - for forcing and hindering participation in electoral campaign. 7 people have the status of suspect. 6 people were detained, 6 people were arrested.



Another 18 reports regarding elections and electoral right were received at the RA Prosecutor General’s Office which, however, did not contain information on the crime envisaged by the RA Criminal Code. In connection with them, the applicants were given proper clarifications in some cases the report was sent to the RA Central Electoral Commission for consideration.



On the polling day – on 20 June, the RA Prosecutor General's Office will operatively and regularly publish information on the reports, alerts, statistics on publications and actions undertaken on criminal offences committed during the polling.
