According to the materials based on operative data prepared by Lori Regional Department of the RA Police, it was found out that S. S., Senior Inspector of Bazum town Division of the same Department of Vanadzor city called with his mobile number to his friend A. A. on March 17, 2020 at about 14:10 o’clock and informed that operative-investigative activities are planned to be held in Yerevan city in order to find the person close to him who had committed a crime under Article 38-296, Part 3 of the RA Criminal Code, and was wanted by the RA Police for the purpose of avoiding serving his sentence. A. A., the wanted person was informed about it and in the result the latter was not found, and the activity undertaken was in vain.
On March 24, 2020 a criminal case was initiated by the Deputy Prosecutor of the RA Lori Region on the grounds of the crime envisaged by Article 308, Part 1 of the RA Criminal Code.
In the result of the preliminary investigation S. S. was charged with committing the above-mentioned crime under Article 308, Part 1 of the RA Criminal Code, and a signature on not leaving was applied as a preventive measure.
The prosecutor supervising the legality of the preliminary investigation confirmed the indictment on May 6, 2020 and sent the criminal case to the Court of General Jurisdiction of Lori Region of the Republic of Armenia for further examination.
In the result of the trial, the prosecutor has set out a petition for the defendant to be sentenced with 1 year of actual imprisonment. However, on June 2, 2020 the Court of General Jurisdiction of Lori Region, pleaded S. S. guilty and was sentenced him to a fine.
Taking into account that the sentence is not equivalent to the degree of public danger and nature of the crime committed, as well as the fact that the prosecutor had set a petition to impose a sentence of actual imprisonment on S. S., currently the issue of filing an appeal against the verdict is being discussed.
The RA Prosecutor General Arthur Davtyan has noted still on February 2020 at the Board meeting of the Prosecutor’s Office, that more punitive policy will be applied against the law enforcement officials who prevent the detection of crimes, act in favor of people avoiding the liability and apply criminal behavior. Considering such phenomena as a betrayal of law enforcement agencies in the fight against crime, the RA Prosecutor General added that all law enforcement agencies are unified against such elements and punishment for them will be inevitable.
Earlier, another criminal case being investigated by the RA SIS was reported by A.A., Head of the Division of Expertise of Lori Regional Department of the RA Police, by means of fulfilling the request of a person close to him, abusing his official position, instead of initiating criminal proceedings, has hidden the firearms, which was used for attempted murder, particularly serious crime and obstructed the detection of the crime, the provision of a comprehensive, full and objective investigation of the case.
The prosecutor supervising the legality of the preliminary investigation of the mentioned case confirmed the indictment and on 29 June 2020 the criminal case with the charge against A. A. under Articles 308 and 334, Parts 1 of the RA Criminal Code, was sent to the Court of General Jurisdiction of Lori region for further examination.
