Within the framework of studies carried out by the instruction of the RA Prosecutor General on the basis of results of monitoring carried out by the RA SSS in the sphere of subleasing land plots in the communities of the regions, the process of initiating criminal cases on the basis of the facts of crimes continues. Within the framework of criminal proceedings, the main emphasis is on the restoration of damage caused to communities and termination of illegal lease agreements.
In particular, by the instruction of the Prosecutor's Office of Gegharkunik region on the basis of materials prepared in the Sevan Police Division it was found out that between Geghamavan community, on behalf of the former head M.V. and the driver of the former Marzpet of Gegharkunik region, on September 03, 2010 a land plot (with an area of 0.002 ha) lease agreement was concluded with an annual rent price of 3.000 AMD. Then on September 24, 2010 the latter concluded a sublease agreement with the Armenian telecom operator with an annual rent price of 840.000 AMD. Thus, property damage in the amount of 8 million AMD was caused to the legitimate interests of Geghamavan community. A criminal case was initiated under Part 2 of Art. 308 of the RA Criminal Code.
By another case, by the instruction of the Prosecutor's Office of Tavush region, on the basis of materials prepared in Dilijan Police Division, factual data were received that the head of Hagartsin community, S. P. in 2013 formed a tender commission, organized and held a formal competition for the lease of a land plot. As a result, on June 27, 2013 he concluded an agreement with a participant who was declared the winner regarding the sublet of a land plot (with an area of 0.002 ha) for 4400 AMD for a period of 20 years. Then, after some time, this person from this agricultural land plot 0.02 hectares transferred for subleasing to one of the communication operators for a rent of 960.000 AMD. As a result, damage was caused to the rights and legitimate interests of Haghartsin community in the amount of about 2 million AMD.
In the Prosecutor's Office of Tavush region, a criminal case was initiated under Part 1 of Article 308 and Part 1 of Article 315 of the RA Criminal Code.
According to the results of the preliminary investigation, 4 million AMD have already been restored from the damage caused to Geghamavan community, and measures have already been taken to terminate the agreement, which was obviously unfavorable for the community and illegally concluded.
And from the damage caused to Haghartsin community, 1 million AMD were voluntarily restored, as well as illegal lease agreements were terminated by mutual agreement.
The preliminary investigation of criminal cases is still in process, measures are being taken to completely restore the damage caused to the communities.
