07.03.2020 | State-owned property was sold for a price 3.5 lower by criminal violations of assessment and alienation procedures

In the Department of State Interests Protection of the RA Prosecutor General's Office were examined the documents received from the RA Committee of State Property Management regarding the process of alienation of state-owned property with an area of 1080 sq.m by the address: Yerevan, Shengavit, Bagratunyac 89.

 

In the course of the studies it was found out that the officials of Committee of State Property Management adjunct to the RA Government, in violation of the provisions of the RA Law “On Real Estate Appraisal Activity”, without concluding an agreement, in November, 2016 offered the LLC to assess the property. On the basis of this proposal, the mentioned property was assessed by the LLC for 28.4 million AMD.

 

By the order of the Head of the State Property Management Department of the Republic of Armenia dated 03.10.2017, the alienation of the mentioned property by a tender was initiated. As a result, the property was sold to a citizen during the 2nd tender for 18.5 million AMD, according to the agreement on the alienation of property concluded in February 2018.

 

In future, “Agency of State Property Inventory and Assessment“ SNCO of the State Property Management Committee of the Republic of Armenia conducted an analysis of the market value of the indicated real estate. As a result, it was envisaged that for June 2017 the market value of the alienated property could be not 28.4 million AMD, but 65 million AMD.

 

In this case, taking into account the fact that the price exceeds the amount of 50 million AMD, according to the decree of the RA Government dated 13.06.2003 N 882-Ն the indicated property should not be alienated by order of the Head of the State Property Management Department adjunct to the RA Government, but on the basis of the decision of the RA Government.

 

That is, the data registered during the study indicate that despite the fact that property with a real value of 65 million AMD with an area of ​​1080 square meters was subject to privatization solely by decision of the RA Government, however, the responsible officials of the State Property Management Department adjunct to the RA Government using the official position contrary to the interests of the service without concluding an agreement in 2016 carried out through the LLC the property assessment works, as a result of which the property was assessed for lower price and was alienated for a price 3.5 times lower.

 

Taking into account that, data containing signs of abuse of official powers by an official were obtained, a criminal case was initiated in the Department of State Interests Protection of the RA Prosecutor General's Office under Part 2 of Art. 308 of the RA Criminal Code. With the instruction to conduct the preliminary investigation, the criminal case was sent to the RA Investigative Committee.
