27.02.2020 | State property located on P. Buzand str. in Yerevan was assessed and alienated by criminal violations. Criminal case was initiated

Within the framework of the prosecutor’s function of protecting state interests, the Prosecutor’s Office of Yerevan City examined the documents received from the RA State Property Management Committee regarding the process of alienation and reassessment of market value for 2017-2018 by State Property Management Department adjunct to the RA Government and “Agency of State Property Inventory and Assessment“ SNCO of 2 buildings by the address: Yerevan, P. Buzand str. N 1/3. With a view to ensure the completeness of the study, additional information was requested and received from the Municipality of Yerevan, the RA State Property Management Committee, and the cadastral case of the property of this territory was also investigated.

 

As a result, it was found out that by the Decree of the RA Government N 29-Ա the RA State Property Management Department was allowed to alienate the territories of building N 1 with an area of 210.4 sq.m. and building N 2 with an area of 103.2 sq.m. and land plots (with an area of 78.9537 sq.m. and 38.7249 sq.m.). On the basis of that, in May 2018, the property was alienated by sale.

 

By the available documents it was found out that in May 2017, buildings of public importance were assessed by the corresponding official of “Agency of State Property Inventory and Assessment“ SNCO without inspecting the place, and the market value was determined in 2014 on the basis of the initial data for 2014 and conclusions on the assessment of the average cost of 1 sq.m. of the apartments in the administrative district of Kentron.

 

Meanwhile, according to the Subpoints 2 and 6 of Part 2 of Article 11 of the RA Law “On Real Estate Appraisal Activity”, the report on the assessment of the real estate must contain: the date of the assessment and inspection results of the place of the real estate, description of the assessment object.

 

As a result, buildings of public importance were alienated for a significantly lower cadastral value.

 

It was also found out that prior to the alienation of the property, construction works were carried out, which in essence were unauthorized buildings, since in the cadastral case there was no final act on the fact of completion of their construction. Moreover, after the completion of the construction works, reassessment of the territories was not carried out.

 

Thus, during 2018 while alienating the state property, its market value was assessed without inspecting the place, in the presence of unauthorized buildings, without making a decision on their status and without reassessing their market value.    

 

Taking into account that in the course of the studies data were obtained on causing significant damage to state interests and including false data or records in the official documents by the competent officials of the RA State Property Management Department and “Agency of State Property Inventory and Assessment“ SNCO in the Prosecutor’s Office of Yerevan City regarding the above mentioned facts was initiated a criminal case under Part 1 of Art. 308 and Art. 314 of the RA Criminal Code. The preliminary investigation of the case was entrusted to the Investigative Department of Yerevan City of the RA IC.
