24.01.2020 | By the abuse of official powers state property was alienated for a price about 13 times below the potential market value

By the Department of State Interests Protection of the Prosecutor General's Office of the Republic of Armenia were studied the documents received from the RA State Property Management Committee concerning the process of alienation of another state-owned property, in the course of which criminal manifestations were detected.

 

In particular, in the course of the study it was found out that according to the conclusion prepared by the LLC in March, 2017 and presented by the RA State Property Management Committee, the market value of the second administrative building with an area of ​​145.2 sq.m., a car wash station with an area of ​​495.32 sq.m., a gas station with an area of ​​18.9 sq.m., an economic building with an area of ​​1062.8 sq.m. production building with an area of ​​3687.6 sq.m., power station with an area of ​​24.5 sq.m., a transformer substation with an area of ​​27.7 sq.m., a workshop with an area of ​​10.14 sq.m., a warehouse with an area of ​​31.36 sq.m., a dining room with an area of ​​220.14 sq.m. the first administrative building with an area of ​​471.22 sq.m., a fence with an area of ​​102 sq.m. /183.6 m3 / and a land plot with an area of ​​24678 sq.m. / by the address: Yerevan, Nor-Nork, Mikoyan street N 18/2 / was assessed for 92.4 million AMD.

 

Meanwhile, the conclusion was drawn up by the LLC by violation of the requirements of the RA Law on “Real Estate Appraisal Activity”. In particular, without concluding an agreement on the provision of services, in addition to that, the conclusion was not confirmed by the signature of the head of the executive body of the company.

 

Despite this circumstance, by the decision of 20.04.2017 of the RA Government, on the basis of market value mentioned in the conclusion the State Property Management Committee adjunct to the RA Government was allowed to alienate property by competition. As a result, by the competition held on September 04, 2017, property was alienated for 35.5 million AMD.

 

Subsequently, an analysis of the market value for 2017 of the aforementioned property was carried out, as a result of which it was found out that the market value of the alienated property as of March, 2017 could be 464 million AMD.

 

Thus, the registered facts indicate that the responsible officials of the RA State Property Management, during 2017 using their official position contrary to the interests of the service, offered the LLC to carry out works on property assessment then, as a result of illegal acts, they accepted the unjustified conclusion presented by the LLC /not corresponding with the requirements of the legislation/. As a result, the property was alienated 13 times below the potential market value and which entailed grave consequences for the state.

 

Based on the results of a study carried out by the RA State Property Management Committee, as well as the Department for the Protection of State Interests of the RA Prosecutor General's Office, a criminal case was initiated  under Part 2 of Art. 308 of the RA Criminal Code.

 

The preliminary investigation of the case was entrusted to the RA IC.
