On the basis of the documents received from the State Property Management Committee of the Republic of Armenia in the Department of State Interests Protection of the Prosecutor General's Office of the Republic of Armenia was studied the legality of the process of alienation of the basement with an area of 70 sq.m and land plot with an area of 20.4 sq.m. (address: Yerevan, K. Ulnetsi 68, N 1).
In the course of the study, it was found out that, by the initiative of State Property Management Department adjunct to the RA Government, according to the conclusion of LLC dated 24.03.2017, the market value of the above property presented by State Property Management Department adjunct to the RA Government and owned by the RA on the right of ownership was estimated 10.3 million AMD.
It was found out that the conclusion was drawn up by violation of the requirements of the RA Law on “Real Estate Appraisal Activity”. In particular, those parts of the conclusion, the content of which relates to the parts about the potential market value of the said property, were not signed by the appraiser, and the conclusion was not confirmed by the signature of the head of the executive body of the LLC.
Despite this circumstance, by the decision of 20.04.2017 of the RA Government on the basis of market value mentioned in the conclusion State Property Management Committee adjunct to the RA Government was allowed to alienate property by competition. According to the results of the competition held on June 30, 2017, property was alienated in the amount of about 6 million AMD.
However, in the course of the analysis submitted on December 6, 2019, by "State Property Inventory and Assessment Agency" SNCO it was found out that as of 2017 the potential market value of this property could be approximately 19 million AMD or approximately 2 times higher from the estimated value.
Tհus, the registered facts indicated that the responsible officials of State Property Management Committee adjunct to the RA Government used their official position contrary to the interests of the service. In particular, an unreasonable conclusion, according to which the market value of the property was estimated at about 2 times lower than the potential market value, served as the basis for responsible officials to determine the value of the property and further for alienation through competition. As a result, property was alienated at a price about 3 times lower than the potential market value, which entailed serious consequences for the state.
Taking into account that during the investigations, data have been obtained containing signs of crimes, a criminal case was initiated in the Department of State Interests Protection of the Prosecutor General's Office of the Republic of Armenia under Part 2 of Art. 308 of the RA Criminal Code.
The preliminary investigation of the case was entrusted to the RA IC for the preliminary investigation.
