25.10.2019 | Damage in the amount of more than 12 million AMD caused by fraud with the use of “Tax Free “has been restored

On March 11, 2019 a criminal case has been initiated in the investigation and operational-search department of the State Revenue Committee of the Republic of Armenia in accordance with Point 1 of Part 3 of Art. 178 of the RA Criminal Code concerning the case of theft committed by A. G. in the amount of 3.300.000 AMD and damage caused to the state in the same amount.

 

In particular, by the order of “ Tax Free “, A. G. presenting the passport of the Russian Federation, during 2017-2018 has purchased various goods from some companies for 66.323.000 AMD / including VAT - 12.280.000 AMD / - watches and gold jewelry. Then he submitted the relevant documents to the customs authorities, on the basis of which, in accordance with the RA Government Decision No. 751-Ն of 29.06.2017, he received VAT refunds included in the prices of these goods. According to the above-mentioned decision of the Government, adopted with the aim of encouraging the export, in case of the export of goods purchased by a foreign citizen, including a citizen of another country, the VAT paid in the territory of the Republic of Armenia is reimbursed.

 

However, by a letter received from the PVD of the RA Police, it has been established that A. G. is not only a citizen of the Russian Federation, but also of the RA. And according to the RA law “On Citizenship “ a person with dual citizenship of the Republic of Armenia is recognized only as a citizen of the Republic of Armenia, that is, A. G. did not have the right to VAT refunds.

 

At the same time, it has also been established that A. G. while purchasing the goods in the territory of the Republic of Armenia has constantly showed the passport of a citizen of the Russian Federation, and the employees of the companies from which he purchased goods were not informed about his citizenship.

 

In the course of the preliminary investigation, as a result of the study of VAT refund accounts and a statement from “Converse Bank” CJSC, it has been found out that during 2017-2018, A. G. has received 9.171.724 AMD in cash and 3.108.699 AMD – non-cash.

 

On August 2, 2019, in the division for investigation of crimes committed in the territory of the international airport << Zvartnots >> of the Investigative Committee of the Republic of Armenia, a decision has been made not to carry out criminal prosecution and to terminate the proceedings on the basis of the absence of corpus delicti in the acts of A. G.

 

However, the prosecutor, who oversees the legality of the preliminary investigation, by the investigation of the materials of the criminal case and the legality of the decision made by the investigator, came to the conclusion that, in order to give criminal legal assessments to the acts of A. G. and other people, to ensure the completeness and comprehensiveness of the investigation, it is necessary to carry out some investigative and procedural actions. And on this basis, the prosecutor has overturned the decision on not to carry out criminal prosecution and termination of criminal proceedings.

 

During the further preliminary investigation, a charge has been brought against A. G. in accordance with Point 1 of Part 3 of Art. 178 of the RA Criminal Code.

 

As a result of the work of the prosecutor's office of Yerevan City, on October 23, 2019 the latter has almost completely restored the damage caused to the state by presenting a receipt on the transfer of the amount of 12.280.000 AMD to the deposit account of the prosecutor's office of the Republic of Armenia.

 

Preliminary investigation is still in process.
