Within the framework of the function of initiating a lawsuit for the protection of state interests, the RA Prosecutor General’s Office continues to investigate the results of inspections /received from state agencies/ carried out by the internal control mechanism.
In particular, on the basis of a letter received from the State Property Management Committee of the Republic of Armenia and the attached documents, by the study carried out in the Department for State Interests Protection of the RA Prosecutor General's Office it has been found out that the officials of the State Property Management Committee of the RA by the violation of the requirements of the RA Law on Procurement, without processes of procurement established by law and without concluding an agreement in 2017 have proposed LLC to carry out property assessment.
Based on this proposal, 20.05.2017 LLC has carried out the assessment of real estate / area of 286.4 sq.m. /, which is a state property / address: Yerevan, Erebuni, st. Dimitrov, /, as a result of which the property has been estimated 28.7 million AMD. Based on this assessment, in 2018, this property has been alienated at auction for 20 million AMD.
Hereinafter, an analysis of the market value of this property for 2017 has been carried out, and as a result of this, it has been found out that the market value of the alienated property as of 2017 was not 28.7 million AMD, but 65 million AMD.
It has been found out that in the process of assessment of this property the requirements of assessment standards have been violated by LLC. In particular, area and floor have not been taken into account. As a result, property with a real value of 65 million AMD has been assessed 3 times less. Based on this, a false conclusion has been drafted by the LLC expert and approved by the director, and on the basis of this, the property has been alienated and the state has suffered damage in the amount of 45 million AMD.
According to the results of the investigation, a criminal case has been initiated under Part 2 of Art. 308 and part 2 of Art. 325 of the Criminal Code of the Republic of Armenia.
The preliminary investigation has been entrusted to the Investigative Committee.
