On March 17, 2019, at around 19:30, a group of compulsory military servicemen at the permanent deployment of the RA Defense Ministry's N military unit refused to perform the duties prescribed by the schedule of the day by stopping them. They voluntarily left the territory of the unit and, after only about two hours, returned to the service.
Based on the materials prepared in connection with this incident, on April 25, in the military prosecutor's office of Goris garrison a criminal case has been initiated under part 2 Article 364 of the RA Criminal Code and sent for investigation to the Ninth Garrison Division of the Main Military Investigation Department of the RA Investigative Committee. It also turned out that on March 16, at around 09:00, the commander of the same unit, colonel R.S., being in his office and wanting to leave the impression of a demanding commander went beyond official powers. A criminal case has been initiated in the military prosecutor's office of Goris garrison under part 1 article 375 of the RA Criminal Code and sent for investigation to the Ninth Garrison Division of the Main Military Investigation Department of the Investigative Committee of the Republic of Armenia.
To conduct a comprehensive, complete and objective investigation, it has been decided to merge three criminal cases into one proceeding. When comparing the evidence obtained during the preliminary investigation on April 15 and 16, five servicemen have been charged under part 2 article 364 of the RA Criminal Code.
On April 16, the commander of a military unit, colonel R.S. has been charged under part 1 article 375 of the RA Criminal Code. It has been decided to elect as a preventive measure the written undertaking not to leave the place.
On the same day, the prosecutor has made a decision on temporary termination of duties of R.S.
The preliminary investigation of the criminal case continues.
Note: Every person suspected in or charged with a criminal offense shall be presumed innocent unless proved guilty in the manner prescribed by the RA Criminal Procedure Code and unless the verdict comes into legal force.
