01.02.2019 | Prosecutorial supervision over the lawfulness of the law on amnesty continues. Violations have been registered

By the order of the RA Prosecutor General Artur Davtyan control and supervision has been established  over the legality of the process of applying the RA Law  on Amnesty on Criminal Cases on the occasion of the 2800th Anniversary of the Foundation of Erebuni-Yerevan and the 100th Anniversary of the Declaration of Independence of the First Republic of Armenia, which entered into force on November 6 , 2018.

 

The legality of amnesty decisions regional units of the probation service of the Ministry of Justice of the Republic of Armenia, as well as heads of penitentiary institutions of the Ministry of Justice of the Republic of Armenia is also considered.

 

Cases of incorrect application of the amnesty law in respect of 19 persons have been recorded (5 in Shirak region, 3 in Lori region, 1 in Gegharkunik, Kotayk and Aragatsotn regions, 3 in the prosecutor’s offices of administrative districts of Yerevan, 4 prosecutors of the Department of Supervision over Legality of Pre-trial Criminal Proceedings of the RA Prosecutor General’s Office) to correct them, prosecutorial measures have been taken, in particular, the relevant procedural decisions that have been  made with violations have been eliminated.

 

Prosecutorial supervision continues over the legality of the application of the RA Law on Amnesty. Special attention is paid to the full protection of the rights of persons subject to amnesty, especially in order to exclude any possible grounds for the unlawful or unlawful use of an amnesty act.
