As a result of the examination and investigative and operational - search activities undertaken by the working group of the RA Prosecutor General’s Office concerning the reports that contain clear signs of electoral offences during pre-electoral period and on the day of parliamentary elections (02/04/2017) 19 criminal cases have been initiated.
1) Out of the total 19 cases, 12 have been initiated under Articles 153 and 34-153 of the RA Criminal Code (regarding multiple voting attempts or voting instead of another person) .
From the criminal cases initiated under the above-mentioned Article
- criminal proceedings of one case have been terminated for lack of corpus delicti
- one criminal case has been sent to the court with a petition to apply compulsory treatment against 1 person
- within the framework of 10 criminal cases a charge has been brought against 11 people
- 8 criminal cases against 8 people have been sent to court with a bill of indictment
- preliminary investigation of one criminal case against 2 people has been completed
- preliminary investigation of one criminal case is still in process
2) 3 criminal cases have been initiated under Article 154 of the RA Criminal Code (violation of voting secrecy). In one case a charge has been brought against one person and preliminary investigation of 3 criminal cases is in process.
3) 3 criminal proceedings have been initiated under Article 149 of the RA Criminal Code ( impeding of the activities of mass media representative). From the abov-mentioned cases two have been merged and sent to court with the bill of indictment under Article 28, Part 1 of the RA Criminal Procedure Code and preliminary investigation of one criminal case is in process.
4) 1 criminal proceedings have been initiated under Article 154.2 of the RA Criminal Code (giving bribe to the voters by candidates, parties, (party alliances), initiative groups on referendum or impeding of voting rights of citizens). There are no accussed by this case and preliminary investigation is in process.
