10.02.2020 | The Head of Chambarak Division of the RA Police was charged within the framework of a criminal case initiated in connection with the publication of getting evidence with truncheon and gas mask

On 22.11.2019 concerning the fact of abuse by people performing public service, with a view to prepare materials in the manner established by Articles 180-181 of the RA CPC, the RA Prosecutor General's Office sent to the RA SIS the publication and video material entitled “Native policemen get evidence with truncheon and gas mask” (published on 21.11.2019 on the website “NewsMedia.am”), as well as a letter from the RA Human Rights Defender regarding this case.


On 23.11.2019 in the RA SIS under Part 2 of Art. 309 of the RA Criminal Code, a criminal case was initiated. During the preliminary investigation, the identity of the person who was subjected to violence was established, the latter was recognized as the victim by the case.


At the same time, by the combination of sufficient evidence obtained in the course of a comprehensive, complete and objective investigation a decision was made to involve              N. S. - Head of Chambarak Division of the RA Police as an accused under Part 2 of Art. 309 of the RA Criminal Code (at the time of commission of crime Article 309.1 was not included in the RA Criminal Code). The latter was charged for deliberately resorting to violence and committing acts with the use of special measures that were obviously beyond his powers while occupying the post of a Senior Detective Officer of Arabkir Division of Yerevan Department of the RA Police from February, 2007 to May, 2010.


In particular, at the beginning of November 2008, in the working room of V. N -Head of Criminal Investigation Division of the same Department with the participation of the latter and other employees, N. S., talked with A. M., who was brought to the Division on suspicion of committing the mentioned crime. After the latter denied the circumstance  of his involvement in the case, before the dawn, they brought him to V. N.’s working room about 5 times, where, together with other employees they intentionally resorted to violence demanding to accept the burglary, threw A. M. on the floor, put on a gas mask, with hands and truncheon hit him, causing physical pain.


As a result of the abuse of powers with the use of violence by N. S., substantial damage was caused to the rights and legitimate interests of A. M. Thus the latter was subjected to inhuman, degrading and cruel treatment.


The preliminary investigation is still in process. Under the conditions of proper prosecutorial supervision, a comprehensive, complete and objective investigation of the circumstances of the case is carried out to establish all the circumstances of the case and give a criminal legal assessment of the acts of all people who committed the alleged crime.


Notice: Every person suspected in or charged with a criminal offense shall be presumed innocent unless proved guilty in the manner prescribed by the RA Criminal Procedure Code and unless the verdict comes into legal force.
