21.01.2020 | As a result of the alienation of state property, carried out on the basis of an assessment made by violations, damage in the amount of about 500 million AMD was caused to the state

In the course of the study by State Interests Protection Department of the RA Prosecutor General’s Office of the documents received from the State Property Management Committee of the RA, it was found out that the officials of the RA State Property Management, in violation of the requirements of the RA Law “On Property Assessment Activities”, without legal basis and concluding an agreement, in 2016 proposed to carry out property assessment works.

 

On the basis of this offer, on 23.08.2017 LLC carried out an assessment of a boiler house with 55.9 sq.m. of the administrative building with an area of 2503.4 sq.m. and a land plot of 0.12 ha. by the address: Yerevan, Kentron, Leo 54. As a result, the property was assessed for 515.890.000 AMD.

 

On the basis of the mentioned assessment, on 17.05.2018 the aforementioned property was alienated by tender for 360.620.000 AMD.

 

Subsequently, an analysis of the market value for 2017 of the aforementioned property was carried out, as a result of which it was found out that the market value of the alienated property as of 2017 could be not 515.890.000 AMD, but 850.000.000 AMD.

 

It was also found out that in the process of assessment of the indicated property the requirements of the assessment standards were violated, in particular, the target value of the assessed property and the square were not taken into account.

 

Thus, the registered facts indicate that the officials of the RA State Property Management, using their official position contrary to the interests of the service, violating the requirements of the RA law “On Property Assessment Activities”, without a legal basis and concluding an agreement, in 2016 offered the LLC to carry out works on property assessment by the address: Yerevan, Kentron, Leo 54. As a result, the LLC specialist, having violated the requirements of the assessment standard, in particular, not taking into account the target value of the property, the square, made a false conclusion, and according to the conclusion, property with a real value of 850.000.000 AMD was estimated for 515.890.000 AMD, which served as basis for a tender for the alienation of the said property. As a result, the mentioned property was alienated 3 times lower than the real value and damage was caused to the state in the amount of about 489.380.000 AMD.

 

Based on the results of a study carried out by the RA State Property Management Committee, as well as Department for the Protection of State Interests of the RA Prosecutor General's Office, a criminal case was initiated  under Part 2 of Art. 308 of the RA Criminal Code.

 

The preliminary investigation of the case was entrusted to the RA IC.
