02.12.2019 | RA Military Prosecutor's Office informs and warns

The Military Prosecutor's Office of the Republic of Armenia informs and warns that after 31.12.2019, thе legislative legal order will no longer be in effect, according to which citizens who have been prosecuted on the basis of evasion of compulsory military service can pay to the RA state budget the envisaged amount of money in the manner prescribed by law, thus be absolved of criminal liability and register for conscription.

 

The RA Law “On Citizens Who Did Not Pass Compulsory Military Service in Violation of the Established Order” applies to citizens who are not called up for compulsory military service (evaded from military service) by the violation of the legislation and who have reached the age of 27 (in the case of reserve officers the age of 35 ), or those citizens who, until they reach the age of 27 (35) years, have received grounds for exemption from compulsory military service or getting a deferment from compulsory military service, against whom criminal prosecution is initiated on the basis of evasion from compulsory military service.

 

According to the mentioned law, a certain group of people who did not pass compulsory military service in violation of the established order were given the opportunity to pay to the RA state budget the amount of money established by law, not to be prosecuted and to get registered for conscription.

 

The applicability of the RA Law “On Citizens Who Did Not Pass Compulsory Military Service in Violation of the Established Order” was periodically extended. According to the latest legislative amendments carried out on March 6, 2019 by the National Assembly for that purpose, the law applies to people who have reached the age of 27 (in the case of reserve officers  the age of 35) until 01.03.2019, and the law is applicable until 31.12.2019.

 

Taking into account the fact that the mentioned law is applicable until 31.12.2019 and the new law on the extension of the applicability of the law has not been adopted, therefore, after the mentioned period the above-mentioned procedure will no longer be valid and citizens who have not passed the mandatory military service in violation of the established procedure on the basis of this will not be exempt from criminal liability.
