28.11.2019 | Another case of alienation of state property at a price several times lower was revealed. Criminal case was initiated

On the basis of the documents received from the State Property Management Committee of the Republic of Armenia in the Department of State Interests Protection of the  Prosecutor General's Office of the Republic of Armenia was investigated the legality of the process of alienation of the building of the sanitary-epidemiological inspection with an area of 203.5 sq.m and land plot with an area of 506.29 sq.m. (address: Yerevan, Erebuni administrative district, Andrfederatsiya st.).

 

In the course of the study, it was found that, by the initiative of State Property Management Committee adjunct to the RA Government on March 24, 2017, the market value of the above property was estimated by LLC. According to the conclusion on the estimation, the market value was about 8.3 million AMD.

 

However, the above-mentioned conclusion was drawn up by violation of the requirements of the RA Law on “Real Estate Appraisal Activity”. In particular, the conclusion was not confirmed by the signature of the head of the executive body of the company, and the part of the conclusion, which included findings related to the market value of the property, was not signed by the appraiser.

 

Besides, it was found out that the aforementioned process of acquiring appraisal services should have been carried out by the RA State Property Management Committee in accordance with the Law of the Republic of Armenia “On Procurement” and the processes established by the decision of 04.05.2017 of the RA Government. However, the estimation of the property was carried out without any legal justification, in particular, without a service agreement.

 

Under these conditions, by the decision of 20.04.2017 of the RA Government, State Property Management Committee adjunct to the RA Government was allowed to alienate property by competition. During the competition held on September 4, 2019, the property was alienated in the amount of 4.7 million AMD.

 

However, during the analysis conducted on 08.11.2019 by "State Property Inventory and Assessment Agency" SNCO it was found out that as of March 2017 the potential market value of the property could be approximately 40 million AMD or five times higher from the estimated value.

 

Tհus, the registered facts indicated that the responsible officials of State Property Management Committee adjunct to the RA Government, by using their official position contrary to the interests of the service, suggested the company to evaluate the property without any procurement procedures established by law and without concluding an agreement. And the latter prepared and presented a conclusion that contradicted the requirements of the RA Law on “Real Estate Appraisal Activity”, according to which the market value of the property was estimated for about five times lower than the probable market value and alienated at a price of about 8.5 times lower, which entailed serious consequences for the state.

 

Taking into account that during the investigations, data have been obtained containing signs of crimes, a criminal case was initiated in the Department of State Interests Protection of the  Prosecutor General's Office of the Republic of Armenia under Part 2 of Art. 308 of the RA Criminal Code. The preliminary investigation of the case was entrusted to the RA IC.
