11.07.2019 | The indicators of detection of corruption crimes in the RA Shirak region and damage caused to the State have multiplied

The prosecutor's office of Shirak region summed up the results of the activities of the criminal prosecution bodies in cases of corruption crimes revealed in the region in the first half of the year, as well as the initiatives of the regional prosecutor's office in the field of State protection for 2019. The study proves that during the first six months of this year, in the course of proceedings under the supervision of prosecutors of the prosecutor's office of   Shirak region, 42 criminal cases have been initiated on corruption facts. This figure is two times higher compared with the same period of the last year. At the same time, the mentioned 42 criminal cases were also initiated by the prosecutors of the prosecutor's office of Shirak region. From the  detected cases of corruption 14 were registered in the field of education, 13 in local governments, 1 in cadastral, 1 conscript, 2 in agriculture, 1 in banking, 1 in health care, 1 in social security, and 8 cases relate to the  crimes committed by law enforcement officers.


Corruption crimes were manifested mainly through the use of official position, embezzlement or misappropriation of various sizes, fraud or breach of trust causing great damage, abuse of power, official negligence, bribery, mediation in accepting bribes, committing official forgeries, abuse of power by employees of commercial or other organizations, falsification of documents, falsification of documents for evading military service and in the form of their totality.


During the first 6 months of 2019,  criminal proceedings were initiated against 27 persons, of which 2 community heads, 6 school directors, 2 deputy directors, 5 teachers, 5 employees of the administration of Shirak region and 3 employees of the Gyumri municipality, 1 director of an industrial school, 3 citizens for assisting in the commission of a crime by an official.  At the same time, only in relation to 4, the detention has been  chosen as a preventive measure. During this period, 4 criminal cases against  7 persons were sent to court with an indictment, and 2 criminal cases were completed in court, by  which  the verdict of guilty has been brought against 2 persons.


In criminal cases initiated on the facts of corruption crimes, the damage inflicted on the state amounted to 121.5 million drams, of which 49 million drams was repaired with the active participation of prosecutors of Shirak region, and a criminal procedural tool was used to restore the rest. In addition, the damage inflicted to the State in criminal cases is more than 7 times higher than the result of the same period of 2018 (17 million drams).


To ensure proper execution of recovery during the preliminary investigation, a ban was placed on property belonging to the accused. In addition, in 3 criminal cases completed in court the entire claim of prosecutors for damages caused to the State was satisfied for a total of 11 million drams, and the process of confiscation has already begun. In the framework of the materials prepared for the six months of 2019 and initiated criminal  cases of corruption crimes, in order to eliminate the favorable conditions for the crime, as well as to eliminate the revealed violations of State interests, in accordance with Article 30 of the RA Law on the Prosecutor's Office to the Ministry of Education, Science and Culture and sports of RA, marzpet of Shirak region and the mayor of Gyumri were presented 22 petitions on various issues, on 8 of which  disciplinary penalties have been imposed, one school director  has been dismissed from office.


The Prosecutor's Office of the Shirak region has done an active and large-scale work also in the field of the protection of State interests. 153 studies have been performed or are being carried out as part of this function, which includes investing in communities by investing in mineral extraction , environmental protection,  social and educational supervision, auditing, and other areas.


As a result of these investigations, 81 business entities were warned by the prosecutor's office, as a result of which damage to the state was recovered worth more than 39 million drams, which is 3.5 times higher than the total amount of damage identified during the first half of 2018 in the framework of protection of State interests (11 million drams).
